In the morning of the 16.09.10 two anti-tank mines exploded near a civilian bus in the Kurdish province of Hakkari near the village of Peyanis. Ten of the passengers were killed while 4, including a baby, were injured. The passengers were supporters of the Kurdish Peace and Democracy Party (BDP). While the General Staff, the president and the Turkish media are accusing repeatedly the Kurdish guerrillas for having bombed the bus, there is substantial evidence pointing to the a massacre having been committed by counter-guerrillas with close links to the army and the Turkish state.
In the village, where the bus came from, more than 99% of the inhabitants supported the boycott of the recent referendum put forward by the governing party AKP and showed this way their support for the Kurdish movement and its aims of democratic autonomy. People in the region have often been victims of this kind of repression. The attack can be seen as one more attempt to frighten the people of the area.
The attack took place on a decisive date during the unilateral ceasefire of the Kurdish guerrilla, HPG, and seems to have been a well-planned provocation by counter-guerrilla forces, similar to many others during past ceasefires. The attack served the Turkish government as an excuse to cancel planned talks with the BDP.

BAG OF THE “MOUNTAIN AND COMMANDO BRIGADE“OF THE TURKISH MILITARY HAS BEEN FOUND ON THE CRIME SCENE
After the big explosion villagers, who had hurried to the crime scene found a bag from the property of the Turkish military full of ammunition, a camera, two anti-tank mines and other armaments of the military including a manual of the “Turkish ground forces” how to place explosives. The bag bore the ensignia of the “Hakkari Mountain and Commando Brigade.” They found some other military equipment and bags at the crime scene as well.

Shortly after the villagers had found the bag, the military issued an instruction via radio: “We’ve left material. Take it back immediately.”

The soldiers tried to get this back by the use of force included guns but the people did not want to return the bag because they were convinced that proof of the participation of the military in this crime would be hidden. So they documented the bag and its content and then gave it directly to the prosecutor.

Eyewitnesses claimed that the perpetrators had left the crime scene quickly because of another car coming near and therefore left behind a lot of leads.

FAMILIES OF THE KILLED HAVE BEEN THREATENED BY SOLDIERS AND JITEM BEFORE – HINTS OF THE PARTICIPATION OF THE KILLING SQUAD “HANCER TIMI“IN THE MASSACRE
All the villagers of Peyanis support the BDP. Of 970 voters in the village only 5 individuals failed to participate in the boycott of the referendum on the 12.09.10. The families in the village are used to threats from the military and the secret service Jitem, who have been responsible for more than 17,000 killings in the last 20 years. Therefore many people in the village think that the bag of this military unit has been left deliberately to threaten the people. Beside the bag the perpetrators left two bayonets, which is known as the sign of the killing squad “Dagger Teams” (Hancer Timi), which has close links to the military, village guards and Jitem and is known for the killings and torture of political activists in the region.

NO CHASE OF THE PERPETRATORS
In the region where the incident took place ten thousand Turkish soldiers are positioned. The military didn’t make any effort to chase after the perpetrators. Normally if there is an attack Cobra Helicopters, tanks and special units are used. None of this happened. No military were ordered to move out. On the contrary, village guards received the order by radio; “There is a group moving in the area, don’t interfere in their business.” This order has been witnessed by a village guard.

FAMILY MEMBERS OF THE KILLED DECLARE: “THIS IS STATE TERROR”
The father of the deceased driver Cahit Erlo declared: ”A lot of military equipment has been found on the crime scene. This shows who is behind the crime.” A family member of Şirin Kurt, Necmi Kurt declared: “It’s clear who did it. This is state terror. There was all the equipment. The military has hurried to collect the equipment. But we didn’t give it to them; we gave it to the prosecutor. The perpetrators didn’t expect a car to come from behind and had to flee without their equipment. It’s clear that this is work of the state, its state terror.”

KURDISH GUERRILLAS STRONGLY CONDEMN THE ATTACK
The Kurdish guerrillas and KCK declared that this attack was not an action by their forces but a massacre by counter-guerrilla forces. They stated: “Between the 13 August and 20 September we have declared a ceasefire which is still in force. If there is no serious change of the situation then our decision will be valid till the 20 September. In Hakkari our guerrillas exercised its right of retaliation because of the killing of nine members of our defence forces; we made controlled attacks on military posts. Beside those retaliatory actions there won’t be any actions from the side of the People Defence forces (HPG).”

Furthermore, the KCK stated that they had nothing to do with the attack in Hakkari which cost the lives of ten civilians. The massacre bears the handiwork of the state run counter-guerrilla. The massacre has also to be seen as a kind of punishment for the active participation of the people of the region in the boycott of the referendum.

“The attack perpetrated in Peyanis on a civilian car, this counter-guerrilla attack, is an attack on the democratic will for freedom of the Kurdish people. The attack is an attempt by the state-run counterforce to punish and suppress the free will of the people.”

Furthermore, the guerrillas stated that the counterforce regularly carry out attacks in the region and try to attribute blame to the Kurdish guerrillas. Therefore the KCK appealed to the conscience of Turkish and international media.
